For the purposes of this declaration, “Programme Organisers” means AISL Outdoor and any camp operator, programme provider, activity provider, coach, teacher, instructor, venue operator, transport provider, medical service provider or other contractor engaged directly or indirectly by AISL Outdoor, or by any camp operator or programme provider engaged by AISL Outdoor, to organise, manage, deliver, facilitate or support any part of the programme, together with their respective directors, officers, employees, agents and personnel acting within the scope of their duties or engagement.
I confirm that I am of legal age and possess full rights to enter into a contract in my own name and that I am the parent or legal guardian of my minor child, or otherwise have authority to provide the consents contained in this declaration on behalf of my minor child.
I confirm that, to the best of my knowledge, my child is physically and mentally fit to join the programmes and that I have disclosed any relevant medical conditions, allergies, medications, behavioural or other support needs that may affect my child's participation.
I confirm that all the information I have provided above is accurate and true to the best of my knowledge.
I understand that participation in sporting, recreational, travel and outdoor activities involves inherent risks that cannot be completely eliminated even when reasonable precautions are taken. Depending on the programme, these may include physical exertion, slips, trips and falls, collisions, equipment use, weather and environmental conditions, transport and contact with other participants. I have reviewed the relevant programme information and accept the inherent risks of my child’s participation.
I acknowledge that my child is expected to comply with all safety instructions and programme rules. I accept responsibility for any loss or damage resulting from my child's deliberate misconduct, unlawful acts or serious breach of programme rules.
I agree to be responsible for, and to indemnify the Programme Organisers against, any loss, damage, liability, cost or expense reasonably incurred as a result of my child's deliberate misconduct, unlawful acts, or material breach of programme rules, except to the extent such loss, damage, liability, cost or expense is caused by the negligence, breach of duty or wilful misconduct of a Programme Organiser.
I understand that participation in the programme is undertaken at my child's own risk, subject to the Programme Organisers' duty to exercise reasonable care and skill. The Programme Organisers shall not be responsible for any injury, illness, loss, damage or expense arising from participation in the programme, except to the extent caused by their negligence, breach of duty or wilful misconduct. Nothing in this declaration excludes or restricts liability for death or personal injury resulting from negligence, or any other liability that cannot lawfully be excluded or restricted.
I understand that I am strongly encouraged to arrange appropriate insurance coverage for my child in connection with participation in AISL Outdoor Camp(s) including coverage for, where applicable, trip delays, cancellations, medical treatment, accidents, injuries, emergency evacuation and other related risks.
I hereby authorise the Programme Organisers, acting in their sole discretion and in the best interests of my child, to administer or arrange reasonable first aid and to seek, obtain or arrange such medical treatment, emergency medical care, hospitalisation, transportation and related services as they consider necessary or appropriate in the circumstances. Where reasonably practicable, the Programme Organisers will attempt to contact me or my emergency contact promptly. I shall be responsible for any costs incurred for such medical care or treatment.
I understand that AISL Outdoor adheres to a zero-tolerance policy against any misconduct by participants. AISL Outdoor reserves the right to request parents to withdraw their child from the Camp(s) if basic behavioural expectations are not met or where this is reasonably necessary to protect the safety or wellbeing of the participant or others. This includes, but is not limited to:
-
Verbal, physical or psychological abuse, harassment or bullying of fellow campers, staff or other persons
-
Unauthorized use of mobile devices
-
Theft or any other illegal actions
-
Behaviour that consistently distracts other campers or staff
-
Repeated disregard for the staff's directions or guidance
I understand that AISL Outdoor camps cannot be held responsible for weather or environmental conditions, that may interfere with the outdoor programme. I acknowledge that if AISL Outdoor determines that the conditions are unsafe or unsuitable for outdoor activities, the programme may be delayed, changed, relocated or canceled. In such instances, I accept that alternative activities may be provided. Any cancellation or refund will be handled in accordance with the applicable Terms and Conditions.
I acknowledge that relevant health, medical, allergy, medication and emergency-contact information relating to my child may be shared with the Programme Organisers, emergency services and medical professionals where reasonably necessary for programme administration, safeguarding, first aid, medical treatment or emergency care, in accordance with the AISL Outdoor Privacy Policy.
I have read and agree to the Terms and Conditions, Privacy Policy, Disclaimer, and Terms of Service for the Camp, as listed on the AISL Outdoor website, together with the programme description and any activity-specific information provided to me.
For the purposes of the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong), each Programme Organiser may rely upon and enforce any provision of this declaration which expressly confers a benefit on such person or entity.
I understand that if I do not provide any information or consent required for participation, health, safety or emergency medical purposes, my child may be denied participation in the programme and/or the related activities. This declaration shall be governed by and construed in accordance with the laws of Hong Kong. I agree that any dispute arising out of or in connection with this declaration or the programme shall be resolved in such forum as may be agreed between the parties, provided that, in the absence of agreement, AISL Outdoor may propose a forum that it reasonably considers appropriate in the circumstances.
I grant AISL Outdoor and those acting under its authority the right and permission to photograph or record my child and/or myself and to reproduce, publish, print, copyright, or otherwise use those photographs or recordings on AISL Outdoor’s website, social-media channels and promotional materials.
